HIPAA Requirements for Telehealth Notes

· 4 min read

Telehealth is standard in behavioral health — but HIPAA rules for clinical documentation do not relax because the session happened over video. Providers must ensure telehealth notes are created, stored, and accessed with the same safeguards as in-person encounters.

Platform Security Requirements

Use HIPAA-compliant video platforms with encryption in transit. Avoid consumer tools that lack BAAs. Session links should be unique, time-limited, and not shared via unsecured channels. Documentation should be completed within the EHR — not in personal notes apps or email.

Documentation Best Practices

Telehealth notes should document modality (video vs. phone), client location when required by state law, informed consent for telehealth, and clinical content equivalent to in-person sessions. Store recordings only if your policy permits and clients consent — with encryption and access controls.

Access Controls & Audit Trails

Role-based access ensures only authorized clinicians view telehealth records. Audit logs track who accessed charts and when — critical for breach investigation and compliance reviews. PaperlessEHR includes these controls on the Sunbase platform by default.
